1. Description of Service

HermesAI is an AI-powered travel concierge platform designed to assist users in planning and exploring their journeys. The Service includes:

• Trip Planner: Creates custom daily itineraries based on route, concept, group size, and duration.
• Recognizer: Identifies historical artifacts and buildings, providing instant historical context.
• Place Finder: Recommends highly-rated local spots and hidden gems based on location data.

2. Eligibility

By using the HermesAI application, you represent that you are at least 13 years old (or the legal age of majority in your jurisdiction) and possess the legal capacity to enter into this agreement.

3. User Accounts

To access certain features, you must register for an account. You are responsible for:

• Providing accurate information (Name, Email).
• Maintaining the confidentiality of your account credentials.
• All activities that occur under your account.

4. AI-Generated Content & Disclaimers

HermesAI uses artificial intelligence to generate travel itineraries, recognize landmarks, and provide historical information. Accuracy: While we strive for excellence, AI-generated content may occasionally contain factual errors or inconsistencies regarding operating hours, historical facts, or local venue statuses. HermesAI does not guarantee 100% accuracy of any AI-generated responses. User Responsibility: Users are advised to verify critical travel information (e.g., flight times, visa requirements, venue open hours) through official sources before making definitive travel plans.

5. Subscriptions and Payments

Membership Tiers: HermesAI offers a Free Trial, a Normal tier (with limits on Trip Planner and Recognizer, and no Place Finder access), an Explorer tier (unlimited core features, 1 Place Finder use per day), and a Marco Polo tier (unlimited core features, 2 Place Finder uses per day). Billing: Payments are processed via the Apple App Store or Google Play Store. The respective platform's terms apply. Cancellations: You can cancel your subscription at any time through your device's store settings. Refunds are subject to the platform's (Apple/Google) policies.

6. Prohibited Conduct

You agree not to do any of the following:

• Reverse engineer, decompile, or attempt to extract the source code of the app.
• Use the application for illegal purposes or to distribute harmful content.
• Scrape or mass-download AI-generated itineraries or historical data for commercial redistribution.

7. Intellectual Property

All original content, logos, UI designs, and features of HermesAI are the exclusive property of Trimonke. Your use of the app grants you only a personal, non-transferable, and non-exclusive license for personal travel planning purposes.

8. Limitation of Liability

To the maximum extent permitted by law, Trimonke shall not be liable for any indirect, incidental, or consequential damages arising from your use of the app, any reliance on AI-generated content, or any travel-related disruptions or losses.

9. Termination

We reserve the right to suspend or terminate your account at any time if you violate these terms or engage in conduct that we determine to be harmful to the service.

10. Governing Law

These terms shall be governed by the laws of Turkey. Any disputes will be resolved exclusively in the courts of Turkey.
